2. What the Service is β and what it is not
KNS is a technology platform. We let you compare shipping rates across multiple carriers, buy shipping labels, prepare customs documentation, and track shipments from one place.
We are not a carrier. We do not collect, transport, handle, store, or deliver any parcel. Every shipment is carried by an independent third-party carrier β such as USPS, UPS, FedEx, or DHL β under that carrier's own terms and conditions.
This distinction matters:
- The carrier, not KNS, is responsible for the physical handling and delivery of your parcel.
- Delivery estimates shown in the Service are provided by the carrier and are estimates, not guarantees.
- The carrier's own terms and liability limits apply to your shipment in addition to these Terms. It is your responsibility to be aware of them.
We purchase labels on your behalf through our shipping infrastructure provider, EasyPost. Where these Terms refer to a carrier's determination, decision, or process, we mean the carrier's or EasyPost's, not ours.
3. Your account
3.1 Eligibility
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind it, and "you" includes that organization.
3.2 Account security
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Tell us at support@klicnsend.com promptly if you believe your account has been accessed without your authorization.
3.3 Accurate information
You agree that the information you give us β including sender and recipient addresses, parcel weight and dimensions, contents descriptions, and declared values β is accurate and complete.
Inaccurate information has real consequences. Carriers re-weigh and re-measure parcels, and will bill adjustments for discrepancies. Incorrect customs information can cause a parcel to be delayed, seized, returned, or destroyed. See Sections 5 and 7.
3.4 Suspension and termination
We may suspend or close your account if you breach these Terms, if we reasonably suspect fraud or unlawful use, or if required by law or by a carrier. You may close your account at any time by contacting support@klicnsend.com.
Closing your account does not cancel labels already purchased, shipments already in transit, or amounts already owed.
4. Pricing, payment, and your wallet
4.1 Prices
Rates shown in the Service are quoted for the shipment details you enter. A rate is valid only for the parcel and addresses quoted, and may change if any of those details change.
Prices are shown in the currency you select. Where a currency other than US dollars is displayed, the amount is a conversion for display purposes; the actual charge may differ slightly due to exchange rates applied at the time of payment.
4.2 Payment
We accept payment by card (processed by Stripe), by PayPal, and from your KNS wallet balance.
We never store your full card details. Card data is captured and stored by Stripe or PayPal under their own security standards. We retain only a token and limited identifying information such as the card brand and last four digits.
4.3 Carrier adjustments
Carriers routinely audit parcels after collection. If a carrier determines that a parcel's weight, dimensions, or service class differs from what you entered, it will issue an adjustment. You are responsible for these adjustments, and we may charge them to your payment method or deduct them from your wallet balance.
4.4 Your wallet
Your KNS wallet holds funds you have added and amounts credited back to you. Wallet funds:
- may be used to pay for shipments and related charges on the Service;
- are not a deposit, do not earn interest, and are not transferable to another user;
- have no cash value outside the Service except as described in Section 8.
5. International shipments, customs, and duties
If you ship outside the origin country, additional obligations apply.
5.1 Your declarations
You must provide accurate customs information, including a truthful description of contents, quantity, value, and β where applicable β the HS tariff code and country of origin.
The Service may suggest an HS tariff code and may show an estimate of duties and taxes. Both are aids, not determinations. The final classification, and the final duties and taxes, are set by the customs authority of the destination country. Amounts actually charged may differ, sometimes substantially, from any estimate shown.
5.2 Who pays duties and taxes
Unless the specific service you select states otherwise, duties, taxes, and clearance charges are payable by the recipient on arrival. Neither KNS nor the carrier is responsible for a recipient's refusal to pay them.
If a parcel is returned, abandoned, or destroyed because duties were not paid, you remain responsible for the original shipping charge and for any return charge the carrier applies.
5.3 Export compliance
You are responsible for complying with all applicable export controls, sanctions, and import restrictions. You must not use the Service to ship to any person or destination subject to US sanctions, or in breach of any applicable export control law.
6. Prohibited and restricted items
You must not ship anything that is prohibited by law, by the carrier handling the shipment, or by the destination country.
This includes, without limitation: explosives; flammable, corrosive, radioactive, or toxic substances and other dangerous goods; illegal drugs and controlled substances; firearms, ammunition, and weapons where restricted; live animals; human remains; counterfeit goods; currency and negotiable instruments; and any item whose transport is restricted by the carrier or destination.
When you check the dangerous goods declaration in the Service, you are confirming that your shipment complies with this section and with the carrier's own restrictions.
If you ship a prohibited item, the carrier may delay, return, seize, or destroy it without compensation. You are responsible for any resulting loss, cost, fine, or penalty, and no refund or coverage of any kind will be available.
7. Loss and damage coverage
Two distinct forms of protection may apply to a shipment. They are different in kind, and it is important to understand which one you have.
7.1 Included coverage β up to $50, provided by KNS
Every shipment purchased through the Service includes loss and damage coverage of up to $50 USD, provided by KNS itself. This is a contractual commitment from us, not an insurance policy.
What is covered
- Lost β the parcel began tracking but has no delivery scan.
- Damaged β the parcel was delivered but the contents were damaged in transit.
Conditions of payment
Coverage is payable only where the carrier or the insurer confirms the loss or damage. A determination by the carrier or insurer is required in every case. We do not pay claims on the basis of assertion alone.
Time limits for filing with us
- Loss β file no earlier than 15 days and no later than 60 days after the label was created; 90 days for international shipments.
- Damage β file within 30 days of the label being created.
These windows match those of the underlying insurer so that a claim filed with us in time can still be pursued with them. A claim filed outside these windows cannot be paid.
Evidence
We may ask for tracking records, photographs of the parcel and its contents, proof of value such as an invoice, and correspondence with the recipient. For damage claims, the original packaging may be required, since carriers and insurers may need to inspect it. Discarding the packaging may prevent a claim from being paid.
Limit
Our total liability under this section is the lesser of the item's declared value or $50 USD per shipment. Shipping charges are not covered.
7.2 Optional insurance β provided by a third-party insurer
You may purchase additional coverage at checkout. This is an insurance product underwritten by a third-party insurer and arranged through our shipping infrastructure provider. It is not provided by KNS.
The insurer currently offering this coverage is Shipsurance, arranged via EasyPost. We may add or change insurance partners over time. The coverage, exclusions, and claim process that apply to your shipment are those of the insurer in effect at the time you purchase, and are shown to you at checkout.
Where you purchase this coverage:
- The insurer, not KNS, assesses and pays the claim.
- The insurer's own policy terms, exclusions, evidence requirements, and time limits govern.
- KNS's role is limited to arranging the coverage at the time of purchase.
- KNS is not liable for the insurer's decision on a claim, including a decision to reject it.
Items that cannot be insured
Our current insurer does not offer coverage for certain categories of item, including:
- personal goods
- gifts
- samples
- promotional items
- jewelry
- coins and cash
- freight
Pre-owned items can be insured. This list is not exhaustive, and it reflects the insurer currently in place β review the applicable policy in full before relying on coverage. Where we add further insurance partners, the categories available for coverage may change.
Please read this carefully. If the item you are shipping falls into an excluded category, purchasing insurance will not protect it, and a claim will be refused by the insurer. Check the exclusions before you buy. Where coverage is refused because the item was excluded, the $50 included coverage in Section 7.1 remains available, subject to its own conditions.
7.3 Relationship between the two
The $50 included coverage and any purchased insurance are not cumulative for the same loss. Where purchased insurance applies, the claim is made against that policy.
8. Refunds
8.1 Where a label could not be purchased
If you are charged and the carrier does not issue a label, that amount is refunded automatically. By default the refund is credited to your KNS wallet, where it is immediately available to spend on another shipment.
If you would prefer the money returned to your original payment method rather than held as wallet credit, contact support@klicnsend.com. Where you paid for a shipment and received nothing, we will return the funds to the card or PayPal account used, subject to the limits of the payment processor.
8.2 Where a label was issued
Once a carrier issues a label, the shipping charge is generally not refundable by us. Some carriers permit unused labels to be voided within a limited window; where that applies and the label is genuinely unused, we will pass the refund through to your wallet.
8.3 What refunds do not cover
Refunds are not available for: shipments delayed or misdelivered by the carrier; duties, taxes, and clearance charges; parcels delayed, seized, or destroyed because of inaccurate declarations or prohibited contents; or carrier weight and dimension adjustments.
Loss and damage are addressed under Section 7, not this section.
9. Acceptable use
You must not:
- use the Service unlawfully, or to facilitate anything unlawful;
- attempt to gain unauthorized access to the Service, other users' accounts, or our systems;
- interfere with or disrupt the Service, or place unreasonable load on it;
- scrape, copy, or resell rate data, or use the Service to build a competing product;
- impersonate another person, or provide false sender information;
- circumvent any limit, security measure, or restriction in the Service.
10. Intellectual property
The Service, including its software, design, text, and branding, is owned by KNS and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose.
You retain ownership of the content you submit. You grant us a licence to use it as necessary to provide the Service β for example, transmitting addresses to a carrier to produce a label.
Carrier names and logos are the property of their respective owners and are used only to identify the services available.
11. Disclaimers and limitation of liability
11.1 Service provided "as is"
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted or error-free, that rates or delivery estimates will be accurate, or that any duty or tax estimate will match what customs charges.
11.2 What we are not liable for
To the fullest extent permitted by law, KNS is not liable for:
- the acts or omissions of any carrier, including delay, loss, damage, or misdelivery, except as expressly provided in Section 7.1;
- any decision of a customs authority, including delay, seizure, or destruction of a parcel;
- any decision of a third-party insurer on a claim;
- indirect, incidental, special, consequential, or punitive damages, or loss of profit, revenue, data, or goodwill, however arising.
11.3 Cap on liability
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the shipment giving rise to the claim, or (b) $100 USD.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
11.4 Indemnity
You agree to indemnify and hold harmless KNS and its officers, directors, and employees from any claim, loss, liability, fine, or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, the contents of your shipments, or your inaccurate declarations.
12. Disputes and governing law
12.1 Talk to us first
Before starting formal proceedings, contact us at legal@klicnsend.com with a description of the dispute and the outcome you are seeking. Most issues can be resolved this way.
12.2 Governing law
These Terms and any dispute arising out of them are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.
12.3 Jurisdiction
You agree that the state and federal courts located in New Castle County, Delaware have exclusive jurisdiction over any dispute arising out of these Terms, and you consent to their jurisdiction.
12.4 Time limit
Any claim arising out of these Terms must be brought within one year of the event giving rise to it, or it is permanently barred, to the extent permitted by law.
13. Changes to these Terms
We may update these Terms. If a change is material, we will give reasonable notice β by email or by a notice in the Service β before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
The version in force at the time you purchase a label governs that purchase.
14. General
Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and KNS regarding the Service.
Severability. If any provision is held unenforceable, the rest remains in force.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for failure to perform caused by events beyond our reasonable control, including natural disasters, war, labor disputes, carrier network failures, and government action.
